Regulatory Principles Charter

The Authority operates according to core regulatory principles intended to maintain integrity, transparency and stability within the Eritrea Gaming licensing framework.

This Charter establishes the principles that inform the Authority’s approach to application assessment, license administration, compliance supervision and enforcement.

Transparency

The Authority seeks to conduct its regulatory functions openly and to make relevant policies, procedures, requirements and decisions accessible to applicants, licensees and the public.

Regulatory transparency is supported through:

Published application requirements
Clearly defined license conditions
Public license verification services
Published regulatory notices
Publication of material enforcement outcomes
Accessible compliance guidance
Annual reporting on regulatory activity

The public register provides an official means of confirming whether an entity is licensed and whether its license is active, suspended, expired, surrendered or revoked.

Proportionality

Regulatory requirements and enforcement actions should be proportionate to the nature, scale and risk profile of the licensed activity.

When determining an appropriate regulatory response, the Authority may consider:

The nature and seriousness of the matter
The duration and frequency of the conduct
Actual or potential harm to players or the public
Whether the conduct was deliberate, reckless or accidental
The licensee’s regulatory history
The adequacy of internal controls
The adequacy of internal controls
Any remedial action taken
The need to deter future non compliance

Regulatory intervention should be no more restrictive than reasonably necessary to achieve the relevant regulatory objective.

01 — Consistency

Consistency

The Authority applies its requirements, standards and procedures consistently across entities performing comparable licensed activities.

Licensing and enforcement decisions are based on defined criteria, the circumstances of the individual matter and the applicable legal and regulatory requirements.

Consistency does not require identical outcomes in every case. Differences may be appropriate where businesses, risks, license categories, regulatory histories or factual circumstances are materially different.

Accountability

The Authority is accountable for the proper exercise of its regulatory functions within the mandate granted to it by the Eritrean Gaming commission.

Accountability is supported through:

Documented regulatory decisions
Defined internal approval procedures
Maintenance of licensing and compliance records
Publication of material regulatory developments
Public reporting on licensing and enforcement activity
Oversight by the Eritrean Gaming commission

The Authority’s decisions must remain connected to its regulatory mandate and the objectives of the licensing framework.

03 — Integrity and Impartiality

Integrity and Impartiality

Regulatory decisions must be made objectively and without improper influence.

No applicant or licensee is entitled to preferential treatment. Applications are assessed according to the applicable criteria and information available to the Authority.

04 — Risk Based Supervision

Risk Based Supervision

The Authority applies a risk based approach to licensing and supervision.

Greater regulatory attention may be directed toward businesses, products, markets or arrangements presenting higher levels of financial crime, player protection, technical, operational or reputational risk.

Risk based supervision allows the Authority to focus its resources on matters most likely to affect the integrity of the licensing framework.

Procedural Fairness

Where regulatory action may materially affect a license, the licensee should ordinarily be informed of the relevant concerns and provided with a reasonable opportunity to respond, except where immediate action is necessary to protect players, preserve evidence, prevent unlawful activity or safeguard the public interest.

The Authority will consider relevant information submitted by the licensee before reaching a final decision, subject to the applicable enforcement procedures.

Important

The Authority operates within the scope of its regulatory mandate.

It does not ordinarily act as a court or general forum for resolving private commercial disputes between operators, suppliers, affiliates, shareholders, contractors or other third parties.

The Authority may, however, consider a private dispute where the circumstances indicate a possible breach of license conditions, player protection requirements, regulatory standards or applicable law.
